TERMS OF USE FOR POLYGLOTAPP
============================
Effective Date: September 1, 2026
These Terms of Use (the "Terms") govern your access to and use of PolyglotApp, including its website and mobile applications. PolyglotApp is operated by D'Costa Thinkshop in Ontario, Canada. In these Terms, "PolyglotApp," "we," "us," and "our" refer to D'Costa Thinkshop, and "you" refers to each person or organization that accesses or uses PolyglotApp.
Please read these Terms together with the PolyglotApp Community Guidelines and Privacy Policy. If you do not agree, do not create an account or use PolyglotApp.
1. ACCEPTANCE OF THESE TERMS

By creating an account, selecting an option indicating your agreement, or using PolyglotApp after being presented with these Terms, you agree to be bound by these Terms and the Community Guidelines. Our collection, use, disclosure, and retention of personal information are described separately in the Privacy Policy (https://www.polyglotapp.club/privacy/).
If you use PolyglotApp on behalf of an organization, you represent that you have authority to bind that organization to these Terms. In that situation, "you" includes both you and the organization.
2. ELIGIBILITY

You must be at least 18 years old and legally capable of agreeing to these Terms to create an account or use PolyglotApp. You may not use PolyglotApp if doing so would violate applicable law or if we have previously deleted your account and have not authorized you to return.
3. YOUR ACCOUNT
---------------
You agree to:
* Provide accurate and current information where PolyglotApp requests factual registration information.
* Create only an account that you are authorized to use.
* Keep your password and account credentials confidential.
* Notify us promptly at support@polyglotapp.club if you believe your account has been accessed without authorization.
* Take reasonable responsibility for activity conducted through your account, except to the extent caused by our breach of these Terms or where applicable law provides otherwise.
You must not impersonate another person or organization, materially misrepresent your identity, sell or transfer your account, or use another person’s account without permission. We may require reasonable information to verify account ownership or identity before acting on an account request.
Your Display Name does not have to be your legal name, but it must not impersonate another person or organization or materially mislead other users.
4. THE POLYGLOTAPP SERVICE

PolyglotApp enables people to create or join communities and communicate across languages using automated translation. Each community has an owner. Only the community owner may start a conversation within that community, while community members may post replies and participate in its conversations.
PolyglotApp may be accessed through its website or through mobile applications that display the web service. Features may be added, changed, limited, or discontinued as the service develops. These Terms do not guarantee that a particular feature or item of content will always remain available.
5. CREATING AND JOINING COMMUNITIES

An eligible account holder may create or join a community, subject to the functions, requirements, and restrictions available within PolyglotApp. When you join a community, you agree to follow its valid community-specific rules in addition to these Terms and the Community Guidelines.
A community's name, description, purpose, rules, or content must not mislead people, infringe another person's rights, or violate these Terms, the Community Guidelines, or applicable law. Community owners may change their rules. Members who do not agree with a change may leave the community, subject to any rights provided by applicable law.
We do not endorse, sponsor, or guarantee any community merely because it is available through PolyglotApp.
6. ROLE OF COMMUNITY OWNERS
---------------------------
Community owners are users of PolyglotApp. They are not employees, agents, representatives, franchisees, joint venturers, or legal partners of D'Costa Thinkshop merely because they create or moderate a community. They cannot make commitments on behalf of D'Costa Thinkshop.
Using the moderation functions made available by PolyglotApp, community owners are expected to:
* State the community's purpose and communicate any additional rules.
* Keep additional rules consistent with these Terms, the Community Guidelines, and applicable law.
* Consider reports about conversations, replies, or members in their community and take reasonable action using available community-owner functions, including deleting inappropriate content where appropriate.
* Use personal information received in a report only as reasonably necessary for moderation, safety, escalation, or legal compliance; avoid unnecessary disclosure of the report, supporting information, or reporter's identity; and do not retaliate against a reporter.
* Avoid unlawful discrimination, harassment, and retaliation when using moderation powers.
* Escalate to D’Costa Thinkshop matters requiring platform-level action, such as deleting an account or community or addressing content that cannot be handled using the community owner’s available moderation functions.
* Cooperate with reasonable platform-level reviews and enforcement actions.
Community owners may moderate content within their own communities using the functions PolyglotApp makes available to them. They cannot delete accounts, delete other communities, or take action outside their own communities. Matters requiring platform-level action should be escalated to D'Costa Thinkshop.
D'Costa Thinkshop may review or override a community owner's decision, but does not promise to resolve every disagreement about a community-specific rule. Community ownership does not authorize an owner to bind D'Costa Thinkshop.
7. YOUR CONTENT AND RESPONSIBILITIES

"Your Content" means community names, descriptions, rules, conversations, replies, reports, and other material that you submit to PolyglotApp. You retain any ownership rights you have in Your Content. These Terms do not transfer ownership of Your Content to D'Costa Thinkshop.
You are responsible for Your Content and represent that you have all rights, permissions, and lawful grounds needed to submit it and permit the uses described in these Terms. Your Content must comply with these Terms, the Community Guidelines, valid community rules, and applicable law.
Do not submit confidential, personal, or sensitive information that you do not want permitted viewers to see. When making a report, provide only the information reasonably necessary for us or a community owner to understand and respond to the concern. Do not send copies of suspected child sexual abuse or exploitation material; identify its location instead.
8. LICENCE NEEDED TO OPERATE POLYGLOTAPP

When you submit Your Content, you grant D'Costa Thinkshop a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, format, adapt for technical or accessibility purposes, display, transmit, moderate, and create automated translations of Your Content as reasonably necessary to:
* Provide Your Content to the audiences you select or that are indicated by a community's settings.
* Operate, secure, troubleshoot, maintain, and improve the functionality and safety of PolyglotApp.
* Enforce these Terms and the Community Guidelines.
* Comply with applicable law and valid legal process.
This licence permits us to authorize service providers acting on our behalf to process Your Content only for these purposes. It also permits PolyglotApp to display third-party advertisements in, around, or alongside Your Content and permits advertising providers to process the page or context in which Your Content appears to select, deliver, measure, secure, and prevent fraud relating to advertisements, as described in the Privacy Policy.
This licence does not permit us to sell Your Content as our own, use Your Content as advertising creative, imply that you endorse an advertiser without your permission, or use Your Content to train a general-purpose artificial-intelligence or language model.
To the extent permitted by law, you agree not to assert moral rights solely against the technical formatting, accessibility adaptation, automated translation, display, or other limited processing authorized by this section. This does not waive moral rights for unrelated uses.
The licence ends when Your Content is deleted from active systems, except to the extent that content or related information remains temporarily in provider recovery data described in the Privacy Policy, must be preserved for security or legal reasons, has been retained or de-identified as described in the Privacy Policy, or has been copied by other people outside our control.
9. VISIBILITY AND USE OF CONTENT

Content submitted to a community may be visible to its members and, depending on the community and service configuration, may also be accessible to other people or to people who are not signed in. Before posting, consider who may be able to view the community and its conversations.
Your Display Name, as entered during registration, is displayed with your PolyglotApp activity and is not automatically translated. It follows the visibility of that activity and may therefore be visible to community members, other people, or people who are not signed in. Your Username, email address, password, and preferred language are not displayed as profile information.
Your Display Name does not have to be your legal name, but it must not impersonate another person or organization or materially mislead other users. Do not create an account or post if you are not comfortable with your Display Name and activity being visible to the applicable audience.
Do not assume that content is private merely because it appears within a community. Other people may copy, quote, translate, screenshot, or share content outside PolyglotApp despite these Terms or a community's rules. We cannot control or delete copies made by other people outside our systems.
10. AUTOMATED TRANSLATION
-------------------------
PolyglotApp uses automated translation to help members communicate. Automated translations may contain errors, omissions, altered tone, or inaccurate meaning. We do not guarantee that any translation is complete, accurate, appropriate, or suitable for a particular purpose.
The original-language message is the authoritative version of a user's content. You should consult the original or seek qualified assistance before relying on a translation for a legal, medical, financial, safety-related, or other important decision.
You must not deliberately exploit translation errors or language differences to deceive, abuse, or unfairly target another person.
Stored translations are associated with their corresponding conversation or reply and are retained and deleted as described in the Privacy Policy. Deletion may not be immediate in short-lived provider recovery data or where limited preservation is permitted or required for legal, security, fraud-prevention, or dispute-resolution purposes. If original content remains after account deletion under the author name "Deleted User," its translations may remain with it for conversation continuity.
11. ACCEPTABLE USE

You must not use PolyglotApp to:
* Violate applicable law or another person's legal rights.
* Threaten, harass, stalk, bully, exploit, defraud, or unlawfully discriminate against another person.
* Publish another person's private, confidential, or sensitive information without lawful authority or valid permission.
* Post defamatory, unlawful, infringing, materially deceptive, malicious, or seriously harmful content.
* Sexually exploit or endanger a child, distribute or facilitate child sexual abuse or exploitation material, or otherwise place a child at risk.
* Distribute non-consensual intimate material or sexual deepfakes.
* Post sexually explicit or pornographic material, including graphic sexual text, images, audio, video, or generated content, or promote the creation or distribution of such material.
* Promote prostitution, escort services, compensated sexual activity, or sexual exploitation.
* Post gratuitously graphic violence, gore, or animal cruelty.
* Support, recruit for, promote, or glorify terrorism or a violent extremist organization. This does not prohibit good-faith news, educational, historical, or public-interest discussion that does not promote or facilitate such activity.
* Encourage self-harm or dangerous activity, or provide instructions intended or likely to cause serious harm.
* Send spam, malicious code, unauthorized advertising, or repeated unwanted promotions.
* Post demonstrably false information likely to cause serious physical harm or materially interfere with voting or another democratic process.
* Provide instructions, software, products, or services intended to facilitate hacking, unauthorized surveillance, identity theft, or unauthorized access to accounts, devices, systems, or data.
* Interfere with, damage, overload, probe, scrape, reverse engineer, or gain unauthorized access to PolyglotApp or its systems, except to the extent a restriction is prohibited by applicable law.
* Collect information about users by automated means without our prior written permission.
* Evade moderation, account restrictions, security controls, or platform safeguards.
* Use PolyglotApp in another way prohibited by the Community Guidelines.
Commercial or promotional content is permitted only when it is relevant to a community's stated purpose and complies with its rules. Unrelated, deceptive, repetitive, or unwanted promotion is prohibited.
12. REPORTS AND SAFETY CONCERNS

If you believe that content or a user violates applicable rules, you may report the matter to the relevant community owner. You may escalate a matter to D'Costa Thinkshop if the owner has not addressed it, is involved in the complaint, or appears to be misusing moderation authority.
A report should identify the relevant community, content, or account and briefly explain the concern. Knowingly submitting a false, misleading, repetitive, abusive, or retaliatory report violates these Terms.
PolyglotApp is not an emergency service, and reports and email are not monitored continuously. If anyone is in immediate danger, contact 911 or the appropriate local emergency service. Concerns about the online sexual exploitation of a child in Canada may also be reported to Cybertip.ca.

13. PLATFORM REVIEW AND ENFORCEMENT

D'Costa Thinkshop does not undertake to proactively monitor every community, conversation, reply, account, translation, or external link. We may, however, review content, accounts, reports, and related information and take action when we reasonably believe that these Terms, the Community Guidelines, valid community rules, or applicable law may have been violated, or when action may be needed to protect users, other people, or PolyglotApp.
Depending on the circumstances and available platform functions, we may:
* Take no action where a violation cannot be substantiated.
* Request information or clarification.
* Issue a reminder or warning.
* Delete content or associated translations.
* Delete an account.
* Delete a community.
* Preserve information or refer a matter to an appropriate authority where permitted or required by law.
We may consider the nature, context, seriousness, frequency, and apparent impact of conduct; available evidence; previous violations; technical limitations; and legal or safety requirements. We may delete content, an account, or a community without advance notice, particularly where we reasonably consider the matter serious, urgent, unlawful, harmful, or otherwise detrimental to PolyglotApp or its users. Except where applicable law requires otherwise, we are not required to provide the affected user with the evidence, internal deliberations, or a detailed explanation for our decision. We may withhold or limit information where disclosure could compromise privacy, safety, security, fraud prevention, legal compliance, confidential information, or an investigation.
Reports may not receive an individual reply. No particular investigation, response time, outcome, enforcement action, or continued availability of content is guaranteed. Moderation decisions may be imperfect.
Where permitted or required by law and consistent with the Privacy Policy, we may preserve relevant information and disclose it to service providers, advisers, regulators, law-enforcement agencies, courts, or other appropriate authorities.
Where applicable law requires, we will report or notify the appropriate organization or authority, preserve relevant computer data for the required period, and avoid disclosures that could prejudice an investigation.
14. RECONSIDERATION AND APPEALS

You may ask a community owner to reconsider a moderation decision unless doing so would be inappropriate or unsafe. You may then submit an appeal to D'Costa Thinkshop at support@polyglotapp.club.
If we delete your account or community, you may use the same address to request review. The request should identify the decision and explain why it should be reconsidered.
We may decide whether and how to review an appeal. An appeal does not suspend a decision or guarantee a response, a particular review process, or reversal.
15. ACCOUNT TERMINATION AND LEAVING POLYGLOTAPP

You may stop using PolyglotApp at any time and may request account deletion as described below.
We may take reasonable temporary protective measures using available platform functions while investigating suspected misconduct, protecting users or the platform, complying with law, or addressing technical or security concerns. We may terminate access and delete an account for a material or repeated violation of these Terms or the Community Guidelines, unlawful or dangerous conduct, prolonged inactivity, risk to PolyglotApp or others, or discontinuation of the service.
Where reasonably practical and appropriate, we may provide notice or an opportunity to appeal. We may act without prior notice where urgent action is reasonably necessary or where notice could create legal, security, safety, or fraud risk.
Termination ends your right to use PolyglotApp but does not affect accrued rights or provisions that by their nature should continue, including sections concerning content licences for retained copies, intellectual property, disclaimers, liability, responsibility for claims, disputes, and general provisions.
16. ACCOUNT, CONTENT, AND COMMUNITY DELETION

You may request deletion of your account and associated personal information through any deletion process made available within PolyglotApp, through:

We may take reasonable steps to verify that a deletion request is authorized.
When an account is deleted, conversations or replies may remain for conversation continuity only as described in the Privacy Policy. Where retained, they will no longer identify the former account as their author and may instead display "Deleted User." Their stored translations may remain with them. You may also request deletion of conversations or replies associated with your account.
Deletion from active systems may not immediately remove short-lived provider recovery data described in the Privacy Policy or information that we are permitted or required to retain for legal, security, fraud-prevention, accounting, or dispute-resolution purposes. We cannot delete copies made by other users or third parties outside our systems.
A community owner may request deletion of the owner's community. Deleting a community may permanently remove its conversations and replies. We may also delete an abandoned, unlawful, unsafe, or persistently non-compliant community.
17. PRIVACY

The PolyglotApp Privacy Policy explains what personal information we collect, how we use and disclose it, how long we retain it, and the choices and rights available to you. It also describes processing by providers used for hosting, email delivery, automated translation, and advertising, including the use of cookies and similar technologies where applicable.
These Terms do not reduce any rights or obligations under applicable privacy law. If a provision of these Terms conflicts with the Privacy Policy on how personal information is handled, the Privacy Policy governs that subject, subject to applicable law.
18. D'COSTA THINKSHOP INTELLECTUAL PROPERTY

PolyglotApp, including its software, design, branding, documentation, and other materials provided by D'Costa Thinkshop, is owned by or licensed to D'Costa Thinkshop and is protected by applicable intellectual-property laws.
We grant you a limited, personal, non-exclusive, non-transferable, revocable permission to access and use PolyglotApp in accordance with these Terms. Except as expressly permitted by these Terms or applicable law, you may not copy, modify, distribute, sell, license, reverse engineer, or create derivative works from PolyglotApp or its software.
Nothing in this section changes your ownership of Your Content or prevents you from using material you independently own.
19. COPYRIGHT AND OTHER RIGHTS COMPLAINTS

If you believe that content on PolyglotApp infringes copyright or another legal right, send a written notice to support@polyglotapp.club. A Canadian notice of claimed copyright infringement should:
* State the claimant's name, mailing address, and other contact information.
* Identify the copyrighted work or other subject matter and state the claimant's interest or right in it.
* Specify the location data for the allegedly infringing content on PolyglotApp.
* Specify the claimed infringement and the date and time, including the time zone, when it allegedly occurred.
* Include any other information required by applicable law.
A Canadian notice of claimed infringement must not contain, or link to, an offer to settle or a request or demand for payment or personal information. For another type of rights complaint, provide your name and contact information, identify the protected work or right and the challenged content, explain the basis of the claim, and state whether you are the rights holder or are authorized to act for the rights holder.
We may request additional information, forward a notice as required or permitted by law, preserve relevant records, restrict content, or take other appropriate action. Submitting a notice does not guarantee removal. You are responsible for material misrepresentations in a notice.
20. THIRD-PARTY SERVICES, ADVERTISING, AND LINKS

PolyglotApp relies on third-party providers for functions such as hosting, email, translation, and advertising. PolyglotApp may display third-party advertisements, including advertisements delivered through Google AdSense. Advertisements may not appear on every page or at all times. The Privacy Policy describes the information and technologies used in connection with advertising and the choices that may be available to you.
Advertising content is provided by third parties. Unless expressly stated, an advertisement does not mean that D'Costa Thinkshop endorses the advertiser or its products, services, claims, or practices. Your interactions or transactions with an advertiser are between you and the advertiser, subject to applicable law and the advertiser's terms and policies.
PolyglotApp may also contain user-posted links or links to external websites. Third-party services and websites are governed by their own terms and policies.
We do not endorse and are not responsible for third-party content, products, or services outside our reasonable control. Your dealings with third parties are between you and them. Nothing in this section limits responsibility that cannot lawfully be excluded.
If you obtain a mobile application through an app store, these Terms govern your use of the PolyglotApp service and do not replace any standard end-user licence or other terms imposed by the app store for downloading and using the application. If the app-store terms conflict with these Terms, the app-store terms govern only your relationship with the app store and the distribution or use of the application through that store; these Terms govern the PolyglotApp service to the extent permitted by law.
21. SERVICE AVAILABILITY, CHANGES, AND DATA PRESERVATION

PolyglotApp is currently offered without charge and may be supported by advertising. We do not promise that it will always be available, uninterrupted, secure, error-free, or unchanged. Maintenance, security incidents, provider outages, technical limitations, or other events may affect access or result in loss or alteration of content.
You are responsible for keeping copies of content you need. PolyglotApp is not an archival or backup service, and we do not guarantee that content can be recovered.
If paid features are introduced later, the applicable price and additional terms will be disclosed before you agree to purchase them. These Terms do not authorize us to charge you without your agreement. Any non-waivable consumer rights will continue to apply.
22. DISCLAIMERS

To the maximum extent permitted by applicable law, PolyglotApp is provided on an "as is" and "as available" basis. We do not make warranties or representations about:
* The accuracy, reliability, legality, safety, availability, or suitability of user content, communities, translations, advertisements, links, or third-party services.
* The identity, authority, qualifications, or conduct of a user or community owner.
* Whether PolyglotApp will meet your requirements or prevent every harmful, unlawful, or unauthorized act.
Views expressed by users and community owners are their own and do not necessarily represent D'Costa Thinkshop.
Nothing in these Terms excludes or limits warranties, conditions, guarantees, remedies, or other rights that cannot legally be excluded or limited.
23. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, D'Costa Thinkshop and its owners, personnel, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, opportunity, reputation, revenue, or profits, arising from or relating to PolyglotApp, even if advised that such loss might occur.
To the maximum extent permitted by applicable law, the aggregate liability of D'Costa Thinkshop for all claims arising from or relating to PolyglotApp or these Terms will not exceed the greater of:
* The amount you paid directly to D'Costa Thinkshop for PolyglotApp during the 12 months before the event giving rise to the claim; or
* CAD $100.
These exclusions and limits apply regardless of the form of action but do not exclude or limit liability for fraud, wilful misconduct, gross negligence, or another liability, remedy, or statutory right that cannot lawfully be excluded or limited. Some jurisdictions do not allow certain exclusions or limits, so some of this section may not apply to you.
24. YOUR RESPONSIBILITY FOR THIRD-PARTY CLAIMS

To the extent permitted by applicable law, you will indemnify D'Costa Thinkshop against a third-party claim, judgment, liability, and reasonable legal cost to the extent directly caused by:
* Your Content infringing that third party's rights.
* Your unlawful or intentionally harmful use of PolyglotApp.
* Your material breach of these Terms or the Community Guidelines.
This responsibility does not apply to the extent a claim was caused by D'Costa Thinkshop, does not require you to accept responsibility that cannot lawfully be imposed, and does not limit any defence available to you. We will give reasonable notice of a covered claim and reasonable cooperation, subject to legal, privacy, and security restrictions. You may not settle a claim in a way that admits fault by or imposes an obligation on D'Costa Thinkshop without our written consent, which will not be unreasonably withheld.
25. CHANGES TO THESE TERMS

We may update these Terms as PolyglotApp develops or as legal, safety, or platform requirements change. Revised Terms will be posted with a new effective date.
We will provide reasonable advance notice through PolyglotApp or by email before a material change takes effect, unless an earlier change is reasonably required for legal, security, safety, or technical reasons. Where required by law or where a change materially affects your rights or obligations, we may ask you to expressly accept the revised Terms.
If you do not agree to revised Terms, you must stop using PolyglotApp and may request account deletion. Continued use after revised Terms take effect and after notice has been provided constitutes acceptance to the extent permitted by law.
26. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law rules.
Subject to any rights you have under mandatory local law, disputes relating to these Terms or PolyglotApp may be brought before a court of competent jurisdiction in Ontario, Canada. Nothing in this section requires you to give up a court, tribunal, complaint process, or remedy available under applicable consumer, privacy, human-rights, or other mandatory law.
Before starting formal proceedings, you and D'Costa Thinkshop agree to make a reasonable attempt to resolve the matter by contacting the other party and describing the concern. This does not prevent either party from seeking urgent relief and does not extend any legal limitation period.
27. GENERAL PROVISIONS
----------------------
If a court finds part of these Terms invalid or unenforceable, that part will be enforced to the maximum lawful extent or severed, and the remaining parts will continue to apply. A failure to enforce a provision on one occasion is not a waiver of the right to enforce it later.
You may not transfer your account or your rights or obligations under these Terms without our written permission. We may transfer these Terms as part of a merger, reorganization, financing, sale, or transfer of PolyglotApp, subject to applicable law and the commitments described in the Privacy Policy.
We are not liable for delay or failure caused by circumstances beyond our reasonable control, except to the extent applicable law provides otherwise.
Notices and communications may be provided electronically through PolyglotApp, at the email address associated with your account, or by posting on our website. You are responsible for keeping your email address current.
Section headings are for convenience only. The words "including" and "include" mean "including without limitation."
These Terms, the Community Guidelines, and any additional terms you expressly accept constitute the agreement governing your use of PolyglotApp. The Privacy Policy describes personal-information practices and is not intended to reduce rights provided by law.
